Inhabiting plays a fundamental role in ensuring every person's right to live a dignified, flourishing, and non-discriminatory life. This is all the more true for older persons, who have long been among those experiencing heightened social and spatial vulnerability, particularly when classified as "non-self-sufficient". The right to independent living may be understood as a legal strategy to achieve this aim. Recognising the centrality of independent living and its legal significance, the essays in this focus share a common premise: the full humanity of older persons and the imperative to ensure them complete access to human and fundamental rights. From a variety of legal perspectives (and also in dialogue with the sociological one), the essays identify key conditions necessary to uphold this right, including the accessibility of rights, the promotion of active aging, and the strengthening of home care services.<hr/>RESUMEN. El habitar desempeña un papel fundamental en la garantía del derecho de toda persona a vivir una vida digna, plena y libre de discriminación. Esto resulta aún más evidente en el caso de las personas mayores, quienes desde hace tiempo se encuentran entre los grupos que experimentan una mayor vulnerabilidad social y espacial, especialmente cuando son clasificadas como "no autosuficientes". El derecho a la vida independiente puede entenderse como una estrategia jurídica orientada a la consecución de este objetivo. Al reconocer la centralidad de la vida independiente y su relevancia jurídica, los trabajos reunidos en este dossier parten de un presupuesto común: la plena humanidad de las personas mayores y la necesidad de garantizarles el acceso pleno a los derechos humanos y fundamentales. Desde diversas perspectivas jurídicas (y también en diálogo con la perspectiva sociológica), los ensayos identifican las condiciones clave necesarias para garantizar la efectividad de este derecho, entre ellas la accesibilidad a los derechos, la promoción del envejecimiento activo y el fortalecimiento de los servicios de atención domiciliaria. <![CDATA[A Journey Toward Spatial Justice. On the Relevance of Independent Living in the Contemporary "Age of Rights"]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200017&lng=en&nrm=iso&tlng=en ABSTRACT. The article analyses one of the possible trajectories within the spatial turn, focusing on the human right to independent living. The Author will consider the existing tensions, focusing on the emancipatory drive on the one hand and on the deep-seated cultural resistance to change on the other (in the latter case, with particular reference to the Italian context). The ultimate aim of the paper is to highlight how the recognition of this human right contributes today to fostering confidence in the emancipatory and inclusive function of human rights-and, along with it, in the very age of rights itself.<hr/>RESUMEN. El artículo analiza una de las posibles trayectorias dentro del spatial turn, concentrándose en el derecho humano a la vida independiente. La autora examina las tensiones existentes, haciendo énfasis, por un lado, en el impulso emancipador y, por el otro, en la profunda resistencia cultural al cambio (en este último caso, con especial referencia al contexto italiano). El objetivo último del artículo es resaltar cómo, hoy en día, el reconocimiento de este derecho humano contribuye a fomentar la confianza en la función emancipadora e inclusiva de los derechos humanos y, con ello, en la propia era de los derechos. <![CDATA[Older Persons, Independent Living, and Contemporary Global Crises: Limitations and Prospects of International Human Rights Law]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200037&lng=en&nrm=iso&tlng=en ABSTRACT. This paper investigates whether the right of older persons to independent living can be framed within international human rights law. The protection of this right is examined in the context of multiple global crises. With independent living understood as a dimension of dignity and substantive autonomy, the international normative framework is outlined, together with its persistent gaps at the global and regional levels. An analysis is carried out of how armed conflict, migration, climate change, and artificial intelligence reshape choice, identity, belonging, continuity of care, and digital dignity. The structural limitations of current protective measures are identified, while the necessary conditions to strengthen independent living as a meaningful right for older persons are highlighted.<hr/>RESUMEN. Este trabajo analiza si el derecho de las personas mayores a la vida independiente puede enmarcarse en el derecho internacional de los derechos humanos. La protección de este derecho se examina en el contexto de múltiples crisis globales. Entendida la vida independiente como una dimensión de la dignidad y de la autonomía sustantiva, se describe el marco normativo internacional junto con sus persistentes lagunas a nivel global y regional. Se lleva a cabo un análisis de cómo los conflictos armados, la migración, el cambio climático y la inteligencia artificial reconfiguran la capacidad de elección, la identidad, la pertenencia, la continuidad de los cuidados y la dignidad digital. Se identifican las limitaciones estructurales de las medidas de protección actuales, al tiempo que se destacan las condiciones necesarias para reforzar la vida independiente como un derecho significativo para las personas mayores. <![CDATA[Care Relationships in the Digital Age]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200061&lng=en&nrm=iso&tlng=en ABSTRACT. This article explores how e-Health and iCT-based solutions are reshaping care relationships between physicians and elderly patients. Drawing on Norbert Elias's theory of interdependence and processual change, the paper interprets digital health as a sociotechnical transformation that reconfigures professional roles, organizational practices, and power relations in healthcare. While digital technologies can enhance autonomy, continuity of care, and independent living for older adults, their effectiveness depends on patients' health and digital literacy. The article highlights how inequalities in cultural capital and access to technological skills risk producing new forms of exclusion. The analysis argues that socially sustainable e-Health requires not only technological innovation, but also educational, organizational, and cultural investments aimed at reducing digital divides and strengthening relational dimensions of care.<hr/>RESUMEN. Este artículo analiza cómo las soluciones de e-Health y soluciones basadas en las TIC están transformando la relación de cuidado entre médicos y pacientes mayores. A partir del enfoque figuracional de Norbert Elias, el autor interpreta la digitalización de la salud como un proceso sociotécnico que redefine roles profesionales, prácticas organizativas y equilibrios de poder. Aunque las tecnologías digitales pueden favorecer la autonomía, la continuidad asistencial y la vida independiente de las personas mayores, su eficacia depende del nivel de alfabetización digital y sanitaria. El autor subraya cómo las desigualdades en capital cultural y acceso tecnológico pueden generar nuevas formas de exclusión, sosteniendo que una e-Health socialmente sostenible requiere inversiones educativas, organizativas y culturales, además de innovación tecnológica. <![CDATA[Home Healthcare Services for Non-Self-Sufficient Elderly People in Italy<sup>-</sup>]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200073&lng=en&nrm=iso&tlng=en ABSTRACT. In Italy, a significant financial investment is currently underway for home care services for elderly people who are not self-sufficient. Home care assistance has been present since the establishment of the National Health Service, but this system is not without its weaknesses and critical issues. However, the new resources dedicated to this type of care aim only to increase the number of people receiving assistance at home. Without improvements in service, there is a risk of providing insufficient and unequal care to a growing number of people.<hr/>RESUMEN. En Italia, actualmente se está llevando a cabo una inversión financiera significativa destinada a los servicios de atención domiciliaria para personas mayores no autosuficientes. La asistencia domiciliaria existe desde la creación del Servicio Nacional de Salud, pero este sistema no está exento de debilidades y aspectos críticos. No obstante, los nuevos recursos destinados a este tipo de atención tienen como único objetivo aumentar el número de personas que reciben asistencia en el hogar. Sin mejoras en los servicios, existe el riesgo de ofrecer una atención insuficiente y desigual a un número creciente de personas. <![CDATA[Accessibility, Law, Rights. A Temptative Legal-Theoretical Systematization]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200085&lng=en&nrm=iso&tlng=en ABSTRACT. The essay investigates two of the possible applications of accessibility which play two different and specific roles in the contemporary context, moving further and further away from the original meaning that was tied to the claim of non-paradigmatic subjects-regarding the space of rights and inclusion in the related lexicon, norms, and policies. The paper focuses, in relation to law, on accessibility as "access to justice" and, in relation to rights, on accessibility as a possible neoliberal tool for hyper-individual responsibility.<hr/>RESUMEN. El ensayo examina dos posibles aplicaciones de la accesibilidad que desempeñan dos funciones diferentes y específicas en el contexto contemporáneo, alejándose cada vez más del significado original vinculado a la reivindicación de sujetos no paradigmáticos en el ámbito de los derechos y de su inclusión dentro del léxico, las normas y las respectivas políticas. El trabajo se centra, en relación con el derecho, en la accesibilidad como "acceso a la justicia" y, en relación con los derechos, en la accesibilidad como una posible herramienta neoliberal de hiperresponsabilidad individual. <![CDATA[The Right to Take Risks and Make Mistakes: Between Paternalism and the Lack of Protection of People with Intellectual Disabilities in Colombia]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200101&lng=en&nrm=iso&tlng=en RESUMEN. Este artículo incorpora un análisis crítico del derecho a tomar riesgos y cometer errores, consagrado en la Ley 1996 de 2019, sobre capacidad legal de las personas con discapacidad mayores de edad. Se sostiene que las particularidades de la discapacidad intelectual hacen necesarios ajustes normativos y prácticos para el ejercicio de estos derechos, con el fin de evitar dos estados indeseados: el paternalismo y la desprotección. Para llegar a la conclusión advertida se identificaron los principales cambios normativos, para luego describir los rasgos característicos de esta discapacidad y establecer los principales elementos del derecho objeto de estudio y las condiciones para su ejercicio.<hr/>ABSTRACT. This article incorporates a critical analysis of the right to take risks and make mistakes, enshrined in Law 1996 of 2019, concerning the legal capacity of adults with disabilities. It is argued that the peculiarities of intellectual disability necessitate normative and practical adjustments for the exercise of these rights, to avoid two undesirable states: paternalism and lack of protection. In order to reach the stated conclusion, the main regulatory changes were identified, followed by a description of the defining features of this disability, the identification of the core elements of the right under examination, and the conditions governing their exercise. <![CDATA[Los datos personales: ¿nuevo(s) bien(es)?<sup>-</sup>]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200141&lng=en&nrm=iso&tlng=en ABSTRACT. In the absence of a legal definition of "goods," and given both the complexity of the matter and the lack of a clear legislative position on the nature of personal data, this article examines their potential characterization as appropriable and appropriated things. It then addresses the dimension of legal policy, weighing the arguments for and against their appropriation from the perspectives of individual and general interest. Notwithstanding formal resistance, the existing features and conditions reveal a tendency toward their substantive configuration as property.<hr/>RESUMEN. En ausencia de una definición legal de bien y ante la complejidad y la falta de posición legislativa clara sobre la naturaleza jurídica de los datos personales, en este artículo se aborda, desde una óptica conceptual, la cuestión de su eventual carácter de cosas apropiables y apropiadas. Posteriormente, se aborda la dimensión de política jurídica, confrontando los argumentos a favor y en contra de su apropiación desde la perspectiva del interés individual y del interés general. Pese a las resistencias formales, las características y condiciones existentes revelan una tendencia hacia su configuración sustancial como bienes. <![CDATA[The Reconstruction of Contractual Non-Performance Based on Protected Interests: Breach or Systematization?]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200163&lng=en&nrm=iso&tlng=en RESUMEN. Este artículo examina la reconstrucción del concepto de incumplimiento en el derecho contractual moderno a partir de los procesos de modernización y armonización. Analiza el alcance real de algunas de sus novedades, en particular la superación de la culpa como criterio general de imputación y la noción de conformidad como una de las expresiones de esta lógica, vinculada a la obtención de resultados satisfactorios para los intereses del acreedor. A partir de ello, cuestiona ciertas lecturas doctrinales sobre el alcance de estos cambios y plantea interrogantes sobre los límites del deber de cumplimiento y sobre la vigencia de las obligaciones de medios en las prestaciones de hacer. Finalmente, propone reubicar el papel de la culpa y delimitar los intereses jurídicamente protegidos, sosteniendo que las prestaciones de hacer, de medios y de resultado, son compatibles con dichas tendencias, pese a la escasa atención doctrinal que han recibido frente al énfasis tradicional en las prestaciones de dar.<hr/>ABSTRACT. This article examines the reconstruction of the concept of contractual non-performance in modern contract law in light of processes of modernization and harmonization. In this context, it analyzes the actual scope of some of its alleged innovations, particularly the overcoming of fault as a general criterion of attribution and the notion of conformity as one expression of this logic, linked to the attainment of "satisfactory results" for the creditor's interests. On this basis, it questions certain doctrinal interpretations regarding the scope of these changes and raises issues regarding the limits of the duty of performance and the continued significance of obligations of means. Finally, it proposes a reassessment of the role of fault and a delimitation of the legally protected interests, arguing that obligations to perform, whether obligations of means or of result, are compatible with these trends, despite the limited doctrinal attention they have received in comparison with the traditional emphasis involving the transfer of goods. <![CDATA[Economic Analysis of the <em>Rebus Sic Stantibus Doctrine:</em> Critical Assessment of the Colombian Supreme Court's Doctrine]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200197&lng=en&nrm=iso&tlng=en RESUMEN. Este artículo analiza criticamente la doctrina de la Corte Suprema de Justicia de Colombia que impide solicitar el reequilibrio de contratos de derecho privado por circunstancias imprevisibles una vez finalizada su ejecución. A través de un análisis económico del derecho, construido a partir de las posturas de Posner y Rosenfield y de Trimarchi, sostengo que esta restricción jurisprudencial es ineficiente e inequitativa, especialmente en sistemas judiciales lentos. El estudio propone unificar el tratamiento de la imprevisión con el régimen de contratación estatal, abogando por la posibilidad de ajustar el precio post-cumplimiento. Se concluye que la Corte debería rectificar su doctrina para garantizar la eficiencia contractual y la justicia conmutativa.<hr/>ABSTRACT. This paper critically examines the Colombian Supreme Court's doctrine, which prohibits claims for contract adjustment due to unforeseen circumstances in private law contracts once their execution is complete. Through an economic analysis of law, built upon the perspectives of Posner and Rosenfield, and Trimarchi, I argue that this precedent-based restriction is inefficient and inequitable, particularly in slow judicial systems. The study proposes unifying the treatment of unforeseeability in private and public law regimes, advocating for the possibility of price adjustment post-completion. I conclude that the Court should revise its doctrine to ensure contractual efficiency and commutative justice. <![CDATA[Tort Liability for Collective Medical Proceeding]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200231&lng=en&nrm=iso&tlng=en RESUMEN. En este artículo se analiza la viabilidad de responsabilizar a un profesional sanitario por los daños causados por otro que intervenga en el acto médico. Se defenderá la viabilidad, pero limitándola a los casos de delegación de obligaciones o de responsabilidad vicaria en sentido estricto. El estudio se realiza con base en el método dogmático y deductivo, este último consistente en analizar el régimen general de responsabilidad por el hecho ajeno para luego verificar su aplicación al caso especial que se analiza.<hr/>ABSTRACT. This article examines the legal grounds for holding a healthcare professional liable for harm caused by another individual participating in the medical proceeding. It argues in favor of such liability but confines its scope to cases involving the delegation of duties or instances of strict vicarious liability. The analysis follows a dogmatic and deductive methodology: it begins with the general principles governing vicarious liability and proceeds to assess their applicability to the specific context under review. <![CDATA[Breaches of the Pre-contractual Duty to Inform to Consumers that, Based on the Principle of Exceptionality of Punitive Damages, Justify Applying them in Chile]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200269&lng=en&nrm=iso&tlng=en RESUMEN. Se procura determinar qué infracciones del deber precontractual de informar a los consumidores justifican la aplicación de la indemnización por daños punitivos en Chile. Dado que las infracciones a dicho deber que comprometen la dignidad o integridad de las personas pueden verificarse con frecuencia, surge la cuestión de cuándo procede la imposición de daños punitivos, atendida la amplitud de la regulación aplicable. Partiendo del principio de excepcionalidad que rige esta clase de indemnización, se sostiene que su aplicación exige que la conducta infractora sea grave, lo que ocurrirá cuando tenga la capacidad de perturbar significativamente la autonomía o la seguridad que el deber de informar busca proteger.<hr/>ABSTRACT. This paper seeks to determine which breaches of the precontractual duty to inform consumers justify the award of punitive damages in Chile. Given that violations of this duty that compromise the dignity or physical integrity of individuals may occur with some frequency, the question arises as to when the imposition of punitive damages is warranted, particularly in light of the breadth of the applicable regulatory framework. Drawing on the principle of exceptional application that governs punitive damages, it is argued that their award requires a serious breach, which will be present where the conduct is capable of significantly undermining the autonomy or safety that the duty to inform is intended to protect. <![CDATA[Causal Uncertainty and Risk: The Limits of Corrective Justice?]]> http://www.scielo.org.co/scielo.php?script=sci_arttext&pid=S0123-43662026000200301&lng=en&nrm=iso&tlng=en RESUMEN. El presente trabajo cuestiona la idea de que las situaciones de imposición de riesgo e incertidumbre causal, derivadas de un riesgo previo, están fuera del ámbito de la justicia correctiva. Para ello, argumentaré que no existe una única concepción de la justicia correctiva, sino varias, y que no todas rechazan integrar el riesgo dentro de sus límites. Además, sostendré que en ciertos escenarios de riesgo pueden surgir reclamos interpersonales entre las partes, los cuales pueden llegar a ser resueltos por la justicia correctiva, destacando su valor como una forma de justicia interpersonal.<hr/>ABSTRACT. This work challenges the idea that situations of risk imposition and causal uncertainty, arising from a prior risk, fall outside the scope of corrective justice. To this purpose, I will argue that there is no single conception of corrective justice, but rather several, and that not all of them reject integrating risk within their boundaries. Furthermore, I will maintain that in certain risk scenarios, interpersonal claims may emerge between the parties, which corrective justice can potentially resolve, highlighting its value as a form of interpersonal justice.
