^les^aDesde los inicios del constitucionalismo moderno en el siglo XVIII, entre los elementos esenciales que surgieron de las revoluciones norteamericana y francesa y que desde entonces condicionaron la concepción del Estado, ha prevalecido tanto la idea de la existencia de una Constitución concebida como norma suprema producto de la voluntad popular, que prevalece sobre todos los otros actos del Estado, como la idea de que los Gobiernos, igualmente producto de la voluntad popular, se deben estructurar conforme a un régimen político representativo y democrático. El desarrollo de esos elementos en el mundo contemporáneo ha dado origen a nuevas tendencias en el derecho constitucional que han conducido a identificar dichos elementos en sí mismos, además, como derechos de los ciudadanos. En tal marco, este estudio constituye una reflexión tendiente a identificar y precisar tanto el derecho a la Constitución como el derecho a la democracia en cuanto derechos fundamentales de rango constitucional en el orden interno de nuestros países latinoamericanos.^len^aSince the begining of Modern Constitutionalism in the 19th century, among the essential elements that derived from the North American and French Revolutions and conditioned the conception of the Modern State, are the idea of the Constitution as superior law product of the popular sovereignty that prevails over any other State act; and the idea that the government, also product of the popular will, must be established following a representative an democratic political regime. The development of these elements in contemporary World has given rise to new tendencies in Constitutional Law allowing to identity such elements, in addition and in them selfs, as constitutional rights of the citizens. In such framework, this essay is a reflection precisely devoted to identify and define, the right to the Constitution, and the right to democracy, as fundamental rights of constitutional rank within the internal order of Latin American Countries.
