^les^aEn la presente investigación se examina la mala fe, en procura de desentrañar si tiene independencia conceptual y operativa suficiente para tipifcar una figura jurídica autónoma. En ese derrotero y con base en la colectación de los antecedentes normativos plasmados en los códigos civiles europeos y latinoamericanos que citan la mala fe, se procura establecer los parámetros comunes que guían la construcción de su concepto. A partir de ello, se analizan las diferencias y vinculaciones con el dolo y la culpa, para concluir que la figura tiene identidad jurídica propia.^len^aIn the present investigation examines in bad faith trying to decipher if it has enough conceptual and operational independence for typical autonomous legal figure. In this course and, based on the collection of the normative background in Latin American and European civil codes which is mentioned in bad faith, seeks to establish the common parameters that guide the construction of its concept. From this, analyses the differences and links with the criminal intent and guilt, to conclude that the figure has its own legal identity.
