^les^aEste artículo expone cómo la idea federal está ligada a las circunstancias de tiempo y lugar en las que se cristaliza. Así, los elementos del Estado federal dependerán de las necesidades del contexto específico. El modelo federal adoptado en Estados Unidos y Alemania, dos tipos clásicos de esta forma de Estado, respondían a sus necesidades de tiempo y lugar. No obstante, sobre estos casos se construye el concepto jurídico de Estado Federal, que resulta ser muy estrecho para dar cuenta de la cantidad de estados que se denominan federales en el siglo XX. La nueva categoría del federal arrangement permite una configuración flexible y la comprensión de que el Estado federal no puede describirse como una figura estacionada en el tiempo, y que a este tipo de organización estatal no se puede llegar tan solo siguiendo fórmulas jurídicas, sino que debe comprenderse como una institución que evoluciona, condicionada a las necesidades de contexto, como se explica en el caso del proceso federal español.^len^aThis article explains how the creation of the federal idea is dependent upon a specific time and space. The federal idea in the Constitution of the United States is different from the idea of Germany in 1871. It responds to different problems and needs. Nevertheless, the conceptual construction of what a federal state means and the corresponding juridical design were taken out of these particular cases, therefore were very rigid and did not take into account differences in the particular conditions of society. This conceptual construction is re-evaluated in the second half of the XXth century as a more general category offederal arrangement. This category is more flexible and comprehensible of the reality of the context where the federal idea develops, as well as it is able to take into account the specific needs of the population. With this framework, I analyze in this article the Spanish case; I seek to establish the contemporary elements of a federal state, and how the idea evolves in a real environment.
