^les^aLa evolución de la realidad social ha hecho que los contratos en los que hay inmediatez entre las declaraciones de voluntad coexistan con otros contratos realizados con declaraciones de voluntad no simultáneos e incluso que estos alcancen una gran importancia práctica, cuyo principal problema hace necesario un marco jurídico que introduzca elementos suficientes para dar seguridad, integridad y protección de intereses a las partes no presentes. Este artículo describe cómo se perfeccionan este tipo de contratos entre ausentes, ahondando en su regulación jurídica española, exponiendo las soluciones que el derecho comparado hace de la misma y concluyendo finalmente con la propuesta de modernización que del derecho contractual europeo se espera en un futuro.^len^aFor the evolution of social reality, the contracts characterized by the immediacy between the declarations of will coexist with other contracts realized with no simultaneous declarations of will and reach a great practical importance. The main problem of these contracts is the need of a legal framework that introduces sufficient elements to provide security, integrity and the protection of the interests of the parties when they are not present. In this regard, this article describes how this type of contract between absents become perfect, focusing into into Spanish legal regulation, exposing the solutions that comparative law presents and finally concluding with the proposal of Modernization of the European contractual Law that is expected in the future.
