^les^aLa Corte Interamericana de Derechos Humanos suele pronunciarse sobre temas propiamente constitucionales. Se podría sostener que la Corte Interamericana cumple una función constitucional. En consecuencia, el derecho emanado de la Corte Interamericana tiende a configurarse como un derecho constitucional común para los estados. El ejemplo de los pueblos indígenas puede colaborar en la dilucidación de esta hipótesis. Nosotros sostenemos que la Corte Interamericana podría ser considerada un órgano que ejerce justicia constitucional.^len^aThe Inter-American Court of Human Rights regularly addresses constitutional matters. It could be argued that the Inter-American Court carries out a constitutional function. Therefore, the law from the Inter-American Court tends to become a common constitutional law for States. The case of indigenous peoples can contribute to clarify this hypothesis. we consider that the Inter-American Court might be considered as an organ which carries out constitutional justice.
