El presente trabajo de investigación estudia la figura del control de convencionalidad en los tribunales arbitrales y en los laudos arbitrales, acudiendo al estudio del derecho comparado, y realiza un análisis a los sistemas regionales de protección de los derechos humanos en América, Asia, África y Europa para así evidenciar que existe un vacío legislativo en la aplicación del control de convencionalidad a los laudos arbitrales. Se toman precedentes de la jurisprudencia internacional para establecer qué mecanismos procesales pueden utilizarse para la anulación de un laudo que viole normas convencionales contenidas en un tratado internacional de derechos humanos.

The present work of investigation studies figures as the application of the control of convencionalidad in the arbitral courts and in the arbitral awards, coming to the study of the compared right, realizing an analysis to the regional systems of protection of the human rights in America, Asia, Africa and Europe this way to demonstrate that a legislative emptiness exists in the application of the control of convencionalidad to the arbitral awards, taking precedents of the international jurisprudence to establish that procedural mechanisms can be in use for the cancellation of an award that violates conventional procedure contained in an international agreement of human rights.
