Abstract It is the purpose of this article to analyse the application of Civil Law with regards to obligations and commercial contracts in Colombian law. The author will refer to a question that frequently arises in doctrinal discussion: determining whether Civil Law should apply in the cases in which the Commercial Code does not provide provision in matters related to obligations and contracts. In addition to a literature review of the various positions held by authors who have studied the topic, the Supreme court of justice's rulings will be analysed.
