Abstract

HERRERA, MARISA  and  LATHROP, FABIOLA. Parent-child Relationships in Latin-American Legislation. Rev. Derecho Privado [online]. 2017, n.32, pp.143-173. ISSN 0123-4366.  https://doi.org/10.18601/01234366.n32.06.

The Convention on the Rights of the Child has had a reforming impact on Latin American legislation. Relations between parents and children have not been outside this legal renewal. The development would have been quite uneven; at least that is what happens with the figure of parental responsibility. Few states that have introduced substantial changes in the legal regime of parent-child relationships. Others who would have stayed halfway and a third group, who had not yet noted the progress of this international legal tool, observing a pending debt to the human rights of children. Which states have complied with this mandate, how and in what sense to be in accordance with the postulates of the Convention? This is the key question that transversalizes this contemporary study on the figure of parental responsibility in Latin America.

Keywords : Human Rights; rights of children and adolescents; parental responsibility; Comparative Law; Latin America.
