Abstract

ALVAREZ-SALAMANCA, Francisca Leitao. The 'Causa Donandi' in Classical Roman Law. Rev. Derecho Privado [online]. 2018, n.35, pp.55-73. ISSN 0123-4366.  https://doi.org/10.18601/01234366.n35.03.

The following work relates to one of the elements that make up the concept of donation non- mortis causa in classical Roman Law. According to me, one of them is the so-called "causa donandi", explained by traditional Romanists as a subjective intention to donate. However, this paper aims to inquire about the contrary doctrine, that is to say on the idea the "causa" of the donation is objective.

Keywords : Donation; causa; Classical Roman Law.
