Abstract

The work comparatively analyzes whether it is possible to consider that the expiration periods of the guarantees of conformity exclude a higher durability standard. In this research, three situations were distinguished. A first solution prohibits planned obsolescence. Other legislations, without penalizing obsolescence, contemplate other duties that transcend the term of the guarantees (spare parts, information, etc.). Finally, an explicit reference to longer terms is omitted. However, this does not exclude their origin, if they are derived from the principle of sustainable consumption or the general or public interest.
