Abstract

BRANGIER PENAILILLO, Víctor Mauricio  and  MORONG REYES, Germán Adolfo. Justice as a Continuation of Social Resolutions by Other Means: Faints Boundaries between Society and Justice. Colchagua province (Chile), 1820s. Historelo.rev.hist.reg.local [online]. 2016, vol.8, n.16, pp.125-155. ISSN 2145-132X.  https://doi.org/10.15446/historelo.v8n16.54947.

The paper studies the position occupied by the prosecution of interpersonal conflicts by agricultural-livestock property, within the informally social resolutions chain sustained by the parties. This is an analysis of the times and the links mediated between those decompressive measures, in the early years of a province in Chile and its judicial implementation in lay nature, in the 1820s. Hypothesis aims to explain the integration of local justice within the resolute ways used by social actors to tensions arising in a period of declining availability in the use, possession and ownership of agricultural and livestock goods. For this purpose, we worked qualitatively and quantitatively a sample of 83 criminal records, selected from legal types that translated interpersonal disputes for this kind of goods.

Keywords : interpersonal conflicts; social resolutions; judicialization; Colchagua Province; Chile; 19th century.
