Abstract

MORENO CRUZ, Pablo. The Limits to the Exceptio Inadimpleti Contractus: The "good", the "bad" and the "ugly" Right to Withhold Performance. Rev. Derecho Privado [online]. 2013, n.24, pp.133-150. ISSN 0123-4366.

The author, after some indications on the conceptual configuration of exceptio inadimpleti contractus in terms of subjective right and, in particular, as an immunity in Hohfeldian sense, distinguishes three categories of limits on the operation of the exceptio based on some uses of the italian doctrine and jurisprudence: the "good" (but weak), the "bad" (because contrary to good faith) and the "ugly" (because of no contractual self-defense) exceptio inadimpleti contractus. in the last part of this work, the author identifies, this time in relation to the Colombian legal system, the use of good (but weak) exceptio in certain decisions of the Constitutional Court.
