Abstract

The difficult and sensitive situation faced by creditors of support obligations when the support debtor settles his/her domicile or residence abroad or when he/she owns property or earns income in a foreign country -in relation to the effectiveness of support claim alleged- has been of great importance for the international legal community which intention is to ease relevant administrative and legal procedures by entering into several international regulatory instruments such as the Inter-American Convention on Support Obligations held in Montevideo on July 15th, 1989, which has established international procedural co-operation mechanisms and gives competent authorities jurisdiction for determining the applicable right by choosing between the laws of the plaintiff's State and the laws of the defendant's State; that is, the applicable laws for assuring the best protection for support. This Convention entered in full force in Colombia only on July 28th, 2010; for this reason, it is important to know its contents and scope, as well as its challenges for Colombian attorneys when analyzing the support obligations from the compared law
