Abstract

PARRA-GRANADOS, Lina María  and  MONDRAGON-DUARTE, Sergio Luis. The Voluntary Termination of Pregnancy as Restricted Access Right in the COVID-19 Framework. Opin. jurid. [online]. 2020, vol.19, n.spe40, pp.49-66.  Epub Sep 15, 2020. ISSN 1692-2530.  https://doi.org/10.22395/ojum.v19n40a2.

The voluntary termination of pregnancy in Colombia has been recognized in three exceptional cases by the jurisprudence of the Constitutional Court. Since then, a protection framework that removes the obstacles of its practice was developed, however, there are still many barriers that women encounter to access this right. Nowadays, with the emergence of the public health crisis on account of COVID-19, it was pertinent to make a diagnosis of the current state of this right. Thus, a qualitative research based on the hermeneutic method was made, it led to a result framed in the acute limitation to exercise this right, especially for women who live in rural populated towns, due to the restriction of their locomotion, internet access and suitable health services, among others that add to the amount of difficulties generated by the pandemic. The research allows us to conclude that the measures adopted in the framework of the State of economic, social and ecological emergency for the protection of this right are null, since they lack an effective socio-demographic approach that guarantees the protection of voluntary pregnancy interruption in this times.

Keywords : decriminalization of abortion; voluntary pregnancy interruption; sexual and re productive rights; guarantees restriction; rural population; coronavirus disease (COVID-19)..
