Abstract

AGNE TYBUSCH, Francielle Benini  and  SILVA, Priscilla. El desarrollo sostenible frente al buen vivir: la necesidad de buscar formas de vida alternativas. Opin. jurid. [online]. 2021, vol.20, n.spe43, pp.615-633.  Epub Aug 30, 2022. ISSN 1692-2530.  https://doi.org/10.22395/ojum.v20n43a26.

Development, propagated since 1949, and sustainable development, from 1970, have not been able to inhibit environmental degradation. Therefore, in this research, the Ecuadorian (11121-2011-0010) and Colombian (3872-2020) judicial decisions were sought to investigate whether it is possible to think about alternative means of living. To do so, the complex-systemic approach was used, since a transdisciplinary analysis was used to investigate the complexity of environmental claims, since there is a web of relationships that permeate the environmental issue. Regarding the method of procedure, the bibliographical method was used, since we started by reading books, scientific articles, theses, and dissertations about the theme in question, using the techniques of annotations and summaries. It was concluded that, unlike Brazil, there are countries in Latin America that have taken steps towards the realization of a full democracy in harmony with nature, being possible not only the search, but the consolidation of alternative ways of life.

Keywords : development; sustainable; nature; judicial decision; Latin America.
