Abstract

The incorporation of women to the public functions, traditionally considered masculine, is relatively recent and even some more of them are coming up. This topic produces many debates and viewpoints, normally about the necessity or not to apply a positive discrimination and if this undermines the principle of equality. These just highly delicate questions, that involve simple constitutional interpretations, are not always shared by everyone. In this sense, it has carried out a study on the way it selects candidates, comparing different methods used. The objective of this study is to see if the results comply with the legal conditions and the moral equity, as well as to reflect part of the wide casuistry and questions that may arise about it, and whose answers are submitted to judgement in order to know if it's approaching to not only legal but also a society of more equal opportunities. After examined the legal reality, it's suggested that every argument must give front in to a more urgent needs, at least for the moment, but it doesn't mean to abandon the search of formulas for providing equality between genders and a selection according with the functions, pointing a new element to consider.
