Abstract

MONJEAN-DECAUDIN, Sylvie. Translating Law in Judicial Proceedings.Translated byJuan Felipe Zuluaga Molina. Forma. func. [online]. 2024, vol.37, n.1, e4810.  Epub Nov 13, 2023. ISSN 0120-338X.  https://doi.org/10.15446/fyf.v37n1.104810.

To many legal experts, translating law may seem like a mechanical linguistic operation consisting in the transfer of legal terms from one language to another; it is linguistic transcoding by a translator. However, the vocabulary and the discourse of law are built to express the specific features of each legal system. The cultural parameter thus makes the translation work more complex than it first appears, even between two legal systems and two languages with a certain «kinship», as is the case of Spanish and French law. A comparison of the terms and concepts is the most reliable way of translating them.

Keywords : comparative law; law translation; judicial proceedings; interlocutory appeal; interim appeal.
