Abstract The aim of this article consists of constructing a reflection on the regulations, procedures and state structures concerning the government of controversial risks that, for his nature, are articulated with the precautionary principle. With this purpose, there was selected as case of study: the problem of the use of agro-pesticides in Argentina that is analyzed from two axes. The first one focused in the question of the regulation in force and projected where an incipient precautionary inspiration appears, especially in the propositions of legislative reforms. The second one investigates in the procedures and in the state structures that try to manage this hypothesis to identify the specificities that present this type of situations.
