Abstract

BRANQUINHO BARBOZA TOZZI, Rodrigo Henrique. I am the river; the river is me: the attribution of legal personhood to environmental natural entities. Rev. Fac. Derecho Cienc. Polit. - Univ. Pontif. Bolivar. [online]. 2019, vol.49, n.131, pp.255-277.  Epub Mar 26, 2020. ISSN 0120-3886.  https://doi.org/10.18566/rfdcp.v49n131.a02.

One of the major legal debates of our times centers around the attribution of legal personhood to natural entities, such as rivers, lakes and mountains. Some nations have edited laws which recognize natural entities - or the environment in general - as entities with legal personhood. Hence creating innovative situations in the management and protection of natural resources. Taking these examples into consideration, the present paper aims to examine the possibility of providing legal status to natural entities, study foreign experiences and, lastly, consider their application in the Brazilian legislation.

Keywords : Natural entities; attribution of legal personhood; environmental protection; environmental preservation; special legal personhood.
