This research aims to discuss the existing conceptions about the effects of the judicial review system in Paraguay from a perspective of legal certainty. On the one hand, the doctrine indicates that the Constitution and current regulations expressly reveal an inter partes effect due to the declaration of unconstitutionality by the Constitutional Chamber or the Plenary Session of the Supreme Court of Justice. On the other, the interpretation of constitutional provisions by the highest judicial body establishes an erga omnes effect when its Plenary Session makes decisions and an inter partes effect when the Constitutional Chamber does. Can these positions affect the citizen's legal certainty? To answer this question, we resort to parameters set by H. Avila and G. Gómetz to reach relevant conclusions that mainly concern dynamic and static aspects of the norms that regulate Paraguayan judicial review.
