Abstract

ORDONEZ-VARGAS, Laura  and  HEREDIA, Douglas Rodríguez. BEYOND CRIMINAL PUNISHMENT: A DIALOGUE BETWEEN RESTORATIVE JUSTICE AND SOME TRANSITION SCENARIOS IN COLOMBIA. anal.polit. [online]. 2019, vol.32, n.96, pp.36-60. ISSN 0121-4705.  https://doi.org/10.15446/anpol.v32n96.83749.

This article is the result of a research project that proposes a dialogue between the Transitional Justice (JT) and the Restorative Justice (JR) in Colombia. From a multidisciplinary perspective in which legal anthropology and critical theories of law intersects, we seek to explore the articulations and tensions between both models from three perspectives; conceptual, empirical and legal. Making use of an ethnographic methodology and qualitative social research techniques, we approach different contexts connected by the same unit of analysis, namely, experiences and restorative processes in political transition scenarios, related to the implementation of Law 975 of 2005 and the implementation of the La Habana peace agreements.

Keywords : transitional justice; restorative justice; criminal punishment; Colombia peace process.
