The article addresses the difficulties encountered by the exercise of the collective bargaining right by public employees, in public service models supported by the statutory theory of public employment, such as that adopted by Colombia. Similarly, it shows the scope of the concept of working conditions on the stage of public función and the great possibilities that open up for negotiation when operating the legal provisions of that sector of the State with the instruments provided by the international regulatory system that regulates human labor.
