The objective of this article is to establish the existence of inequality between public employees and official workers regarding access to the administration of justice in labour matters since there are different terms to go to claim labour rights before the contentious administrative and ordinary labour jurisdictions. The research method from which the work was carried out is qualitative, using techniques such as documentary analysis of regulations, jurisprudence, and doctrine, as well as the case study technique, which allows us to exemplify and visualize specific events of imbalance in access to the administration of justice. Among the conclusions or findings of the investigation, we find the existence of the infringement of the right to equality in public employees and official workers mainly, because in labour claim events different terms have been established to go in search of labour justice, and this reason constitutes an obstacle in access to the administration of justice in Colombia.
