Abstract

PINTO SARMIENTO, Yenny. Compulsory insurance for working parents of children affected by a serious health condition: A new regulation in Chile. Rev. Derecho [online]. 2022, n.57, pp.54-82.  Epub Sep 30, 2022. ISSN 0121-8697.  https://doi.org/10.14482/dere.57.205.224.

This article briefly sets forth the regulation and consecration of the parents' right to care for their children with certain serious illnesses, regarding the entry into force in Chile of Law No. 21,063. The international agreements, the Chilean regulation before the entry into force of Law N°. 21,063, and later, the regulations of the law, called the Sanna Law, are analyzed. Finally, the Spanish case is analyzed, which leads us to a comparison with the current Chilean regulation and the advances and criticism of the recent legislation. In conclusive terms, it is indicated that there are defects in legislative technique and that the catalog of incorporated diseases allows us to doubt the real scope of the standard.
