Abstract

CHINCHILLA IMBETT, Carlos Alberto. Private property and acquired rights in the process of formalization and clarification of property established by the Decree 902 of 2017, in light of the general principles of law: Good faith and legitimate expectation. Rev. Derecho Estado [online]. 2018, n.41, pp.147-171. ISSN 0122-9893.  https://doi.org/10.18601/01229893.n41.06.

Measures in order to facilitate the implementation of a comprehensive rural reform are established in Resolution 902 of 2017, part of the agreements signed between the Colombian Government and the Revolutionary Armed Forces of Colombia (FARC). Some of these measures might go against the protection of private property. The author proposes a reading of the property protection legitimately acquired based on the general principles of law, good faith and legitimate expectation, in order to avoid misinterpretations when applying the measures of the aforementioned Resolution.

Keywords : Peace accord; good faith; private; legitimate expectation; general principles of law.
