Abstract

The urban dynamics potentialized the importance of public transportation, with the increasing access to technology, the emergence of alternatives aimed to the satisfaction of needs of citizens through services that seek legitimacy within their own regulatory regime, independent of that provided for traditional public service; most of the above believes it's a place for the initiative in the notion of private transport service, either in its current formulation or as they believe it should be conceived, a discussion about its content, preliminarily concluded terms herein to demonstrate the need for reconsideration.

Having verified this need, a proposal is presented that invites to a new reading of the notion of private service based on a systematic approach to its normative consecration.

The analysis required for these purposes allow us to affirm the existence of a context from which the notion derives and depends, so it is stated that the legislative interventions on it, in addition to the material elements underlying the notion of public service, will be in the pragmatic discourse teleologically restricted so that it can be justified from its adequacy in responding to that context.
