Abstract

This article is about the organic Constitution of Peru. In this sense, this article shed light on the most oustanding caracteristics of this part of the constitution and from there it claims about its inconsistences, due to the hybrid process promoted since the origins of the peruvian constitutionalism. Furthermore, this article discuss critically the peruvian constitutional court's jurisprudence about the organic Constitution. In particular, it insists on the decisions ruled by this corporation linked to the question of confidence and to the dissolution of the Parliament. Finally, this article proposes some measures that have to be implemented in the short and mid term in order to strengthen the democratic institutionality of the country.
