The increase of trade relations in recent years, is one of the reasons why the use of contracts as a means to express the will of the parties the most common parts around has become increasingly common. Faced with this move change, the Brazilian State was the need forced to establish parameters able to preserve and limit the social impact that these relationships occur in the would cause in the community society. To this end, certain principles were laid down in the Constitution and other legislative bodies,- within these we find in particular is the principle of 'social function of contract'. Considering the increase in international business transactions and the recent accession of Brazil to the Vienna Convention on Contracts for the International Sale of Goods International Sale and Purchase of Goods-a widely uniform law governing such contracts and is based on purely commercial principles and international principles-it is necessary to analyze the constitutional aforementioned principle mentioned, considering the new business scenario in which it will act apply.
