Abstract

The modern tendency to objectify civil liability has generated different systemic contradictions that require the application of elements of balance between subjective liability and strict liability. To face the permanent abuse of the principle of legality, this paper proposes a way to balance liability using the principle that there cannot be strict liability without quantitative limitation of compensation. Yet, this principle would be apparently in contradiction with the so called principle of full reparation of damage. The paper considers the possible contradiction from the point of view of the moral basis of both kinds of liability as well as the principle of full reparation of the damage. In addition, it deepens the problem from its essential element, as it is the 'loss'. This paper studies also the principle of full reparation of damage from a non traditional point of view. Finally, the author condenses the conclusions reached, which are consistent with the absence of contradiction between the principle that there is no strict liability without quantitative limitation and the principle of full reparation of damage.
