Abstract

BRODEMANN, Eckart. The Chinese European Arbitration Centre. An Introduction to the CEAC Hamburg Arbitration Rules. Rev. Derecho Privado [online]. 2014, n.26, pp.531-558. ISSN 0123-4366.

The Chinese European Arbitration Centre (CEAC) is specialized in China related trade and investment cases from around the globe with a direct or indirect connection to China, however remote. It is tailor-made to the needs of Chinese business. The article gives an overview of the non legal factors underlying CEAC such as the spirit of enhanced neutrality and cooperation. In its core part, it analyses the differences between the CEAC Hamburg Arbitration Rules and the uncitral Arbitration Rules, on which the CEAC Rules are based. It also describes the integration of other legal instruments (such as the cisc and the unidroit Principles of International Commercial Contracts) into the legal concept for CEAC which was discussed over several years with, ultimately, 470 supporters from 47 nations.

Keywords : Chinese European Arbitration Centre (CEAC); China; international arbitration; uncitral Arbitration Rules.
