Abstract

BENEDETTI, Alberto Maria. Notes on the prohibition of joint wills: The validity of mirror wills. Rev. Derecho Privado [online]. 2015, n.29, pp.59-72. ISSN 0123-4366.  https://doi.org/10.18601/01234366n29.03.

This contribution traces the history of the prohibition of joint wills (Art. 589 of the Italian Civil Code), recalling the stages of its complex evolution. The protection of testamentary freedoms has historically served as the justification behind this prohibition, but today's case law reshapes the rule. Today, mirror wills between spouses shall be effective as long as each spouse's will is expressed as a separate document.

Keywords : Wills; mirror wills; testamentary autonomy.
