This article analyzes the position of the Colombian Constitutional Court in the matter of substitutive consent in surgical sterilization of minors with intellectual disability and the coherence with the principles of autonomy and non-discrimination of the International Convention on the Rights of People with Disabilities. I argue this type of consent is a violation of those principles. The principles require the creation of a context where people with disabilities are able to develop their rights.
