Abstract

AGUDELO MOLINA, JUAN DIEGO. Causation and Imputation. The Internal Coherence of the Objective Imputation Theory in the Field of Civil Liability. Rev. Derecho Privado [online]. 2021, n.41, pp.321-353.  Epub Aug 22, 2021. ISSN 0123-4366.  https://doi.org/10.18601/01234366.n41.11.

This paper evaluates the internal coherence of the Objective Imputation Theory, developed by the German criminal lawyer Claus Roxin and Günther Jakobs as a theory of causation and imputation in civil liability. The works research is done under a positivist paradigm, in its logical or analytical aspect, so a conceptual analysis of the research object will be carried out. This analysis will demonstrate that the Objective Imputation Theory is not consistent and lacks systematicity as a theory of causation and imputation in matters of civil liability.

Keywords : but for test; adequate cause theory; objective imputation theory; civil liability; criminal liability.
