Abstract

During the 30's the notion of public service was in the middle of a State systematic juridical construction; the pioneer of its organization was León Duguit, and its acceptance in Colombia caused a certain impact on the internal State policy during the first half of the 20th century. Consequently, this article is intended to analyze whether the ideas brought from the French school during the 1930-1940 period were really reflected on the State activity and public services or their influence was simply a statement, and the topic only remained as a legal and constitutional dogmatic discussion. This validation exercise for the case of Bogotá allows showing an active notion of the public service, fulfilling with the State social function. In order to fulfill the objective proposed, two water supply public service rendering issues are studied; first, it is important to verify in both records and Law 65, 1936 (Republic of Colombia, 1936A)2 that the issues were maybe influenced by the doctrinal tendency named above; second, something similar occurred when rendering this public service in Bogotá City between 1930 and 1940.
