Abstract

MARCIO CRUZ, Paulo; BODNAR, Zenildo  and  STAFFEN, Márcio Ricardo. Transnationalization, Sustainability, and New Paradigm of Law in the 21st Century. Opin. jurid. [online]. 2011, vol.10, n.20, pp.159-173. ISSN 1692-2530.

Due to the emergence of new globalized and transnational scenarios and to the lack of freedom in relation to modernity law paradigm, this article is intended to establish some scientific and theoretical elements about the need for considering the emergence of a new paradigm for law. The article is trying to show that sustainability, together with freedom, should be consolidated as the new paradigm for law in the postmodern age, beyond its scope to be applied worldwide. Procedural law is tackled in such a way that it suggests the dialectics of several social forces, articulating a way harmonized with the most different legal values and interests.

Keywords : Law paradigm; freedom; sustainability; transnationalization; procedural law.
