This article objective is to analyze the restrictions to constitutional rights during states of emergency in the Brazilian and international jurisprudence. For that, the article employed a documentary and bibliographical review as a research technique. As a research method, the inductive model was supported on particular questions of the countries reviewed up to a conclusion on the research topic. The research concluded that there is a need for re-reading the constitutional rights in the light of the new scenario and it is imperative to adopt a less harmful constitutional interpretation.
