Abstract

The article is part of the doctoral thesis research. It is a mixture of research and reflection about the place of memory in the process initiated by the Act 975/2005 or "Justice and Peace." The aim of this paper is to highlight the contradictions in the practice of memory, following the design of the Act, to the detriment of victims and society. To do this, it is assumed that Colombia is part of a transitional justice process but in different ways. Also we define the concept of memory which the analysis is developed. The second part will describe the place of memory in the Act 975/2005 through the judicial process and the work of historical memory group of the National Commission for Reparation and Reconciliation, CNRR. Finally, we will see the practical result of the law in the only ruling Justice and Peace sentence: The Case of Mampuján.
