This article describes the main facts that led to the territorial fragmentation of the Republic of Georgia in the first triennium of the nineties. The article presents the legal elements that back up the unilateral separation of the Abkhazia and South Ossetia regions from a relationship between the secession principle and the principle of self-determination ofpeoples in public international law. The purpose of this essay is to point out that the lingering human rights violations directed against these regions legitimated the application of the right to secession as a last resort for the protection of human rights. The rise of this kind of separatist entities in the post-soviet space presuppose a challenge to international law as they imply a redefinition of concepts such as sovereignty, territorial integrity, and the inviolability of the State borders as a key player of international law and international relations.
