Abstract

DUARTE HERRERA, Lisbeth Katherine  and  MIRAMONTES ROMERO, Jorge Daniel. International Recognition of Palestine: Some Considerations from the Perspective of International Law. rev.relac.int.estrateg.segur. [online]. 2020, vol.15, n.2, pp.131-147.  Epub Sep 25, 2020. ISSN 1909-3063.  https://doi.org/10.18359/ries.4694.

This article aims to establish whether international recognition is a sine qua non condition for Palestine to become a state and whether this recognition is subject to the resolution of its historic conflict with Israel. In light of international law and the theory of the state, it examines the constituent elements of the state, as well as theories of recognition and the United Nations' membership procedure, using secondary sources of information such as academic databases and official documents. Finally, it presents an analysis on the position of the members of the Security Council vis-à-vis the situation in Palestine and reviews whether its recognition depends on solving the ongoing conflict.

Keywords : Creation of states; international law; Israel; international recognition; Palestine; emergence of a nation state.
