Abstract

DAVILA LONDONO, Luis Felipe. Law and violence: A controversial relationship thought from Nietzsche and Foucault. rev.ces derecho [online]. 2015, vol.6, n.2, pp.108-120. ISSN 2145-7719.

It is proposed to revise the notions of law and violence that occur (mainly) in the texts: Genealogy of Morals (1978) and The Gay Science (1974) Nietzsche, and Truth and legal forms (1973) Discipline and Punish birth of the Prison (2005) Michel Foucault. The notions of strong and weak, or aristocrats and commoners are addressed. The relationship between cruelty, memory and forgetting is analyzed. Nietzsche's idea of the justification of punishment as a post construction that legitimizes a primitive aristocratic violence resumes. It also discusses the relationship power-knowledge-violence Truth and legal forms. Finally, throughout the text the influence of Nietzsche's thought outlined in the work of Foucault.
