The interest of this article is to carry out through a bibliographic study in the constitutional, legal, jurisprudential and doctrinal framework the action of the Family Ombudsman as responsible for the adoption process in Colombia. In this study it was found that the Political Constitution, Laws 1098 of 2006 and 1878 of 2018, and other normative national and international documents of obligatory compliance in the national territory regulate the relative to this process. It was possible to highlight some legal gaps and obstacles of institutional origin, which make it difficult for the Family Ombudsman to exercise his or her role in the adoption process, due to the fact that they force their discretion and delay the term in their administrative actions.
