Abstract

HERRERA, Carlos Miguel. The Concept of Solidarity and Its Political-Constitutional Problems.: A Jusphilosophical Perspective. rev.estud.soc. [online]. 2013, n.46, pp.63-73. ISSN 0123-885X.

Often the concept of solidarity has been approached by philosophy from a speculative standpoint, even when referring to sociological references, particularly as one of the foundations of social ethics. In contrast, in the second half of the 20th century the concept had a political-constitutional application as a foundation for the social intervention of the State. However, solidarity has also been analyzed as notion heavily influenced by the political concepts which contain it and by the national traditions in which its meanings are displayed. These dimensions are explored in this article by studying the French case through the use of a legal-positive dimension as a means to reveal some of its political ambiguities.

Keywords : Solidarity; public law; social state; political philosophy.
