New information technology and Internet specially have affected the ways of exploitation of musical Works, and application of copiright laws, too. This article deals with the problems of copyright in musical industry facing the digital environment from a legislative, legal and industrial perspective. In other words, it is about seeking the answers offered by national and international lawmakers for effective protection of copyright in musical industry, affected by the digital environment, and the position that appears in the legal scene from other legal systems in order to give a solution to this problem. The methodology used consists in a revision of national and international legislation and doctrines, implementing legal comparison, in order to identify solutions to this problem from other legal systems.
