This article develops an historical investigation that aims to revel the consensual characteristic of the sale and purchase contract and its influence in the way we theoretically conceive the phenomenon of the transfer of property in the western legal culture sphere, in order to promote unification between 'solo consensu' technique and 'title and mode' system. Situation that ultimately will contribute to the improvement of the trade relations of countries that share an ancestral kinship derived from Roman law.
