Objective:

The main objective of this article is to examine the characteristics of the crime against humanity and its relationship with sexual violence in the Special Jurisdiction for Peace (JEP) in Colombia. It also examines the parameters assumed by the SJP in the assessment of sexual crimes in the context of armed conflict and transitional justice processes.

Method:

As part of the methodology, a review of both documentary sources and theoretical perspectives on human rights was carried out in order to support each of our assessments. The sources consulted are both academic and jurisprudential in nature and the examination is carried out from the qualitative research paradigm.

Results:

A deeper understanding of the Colombian legal framework in relation to sexual crimes in contexts of armed conflict is offered, highlighting the importance of considering sexual violence as a fundamental component of certain crimes against humanity.

Conclusions:

It is concluded that, in the country’s legal framework, conditions have been created for sexual violence to be understood beyond the crime of violent carnal access and as an essential category in the framework of the internal armed conflict, coming to be considered a key component of certain crimes against humanity.
