Resumen

ALVAREZ RESTREPO, Julián Andrés. Cooperation route between Colombia and Nicaragua for the environmental management of the Seaflower marine protected area: based on theories of the common goods. Justicia [online]. 2023, vol.28, n.44, pp.225-242.  Epub 30-Dic-2023. ISSN 0124-7441.  https://doi.org/10.17081/just.28.44.6904.

Objective:

propose an International Cooperation route between Colombia and Nicaragua for the environmental management of the Seaflower biosphere reserve, based on the legal framework of the Law of the Sea and from international environmental law, since although Colombia did not subscribe to the Convention the United Nations on the Law of the Sea, whether it must abide by various instruments of Public International Law that allow for environmental management of the Seaflower biosphere reserve.

Method:

this research is developed from the disciplinary fields of Law and Political Science. It is qualitative in nature with a socio-legal approach, which in terms of Bernal and García is translated as the problems that arise outside the legal system, where the assumption is made of the normative nature of law as an instrument to produce effects within the social reality.

Results:

oth States have been protagonists of a border dispute before the International Court in The Hague; however, in the midst of the litigation, different problems have arisen in the Seaflower marine protected area (border boundary shared by both States), making it pertinent for both States to establish in their maritime ocean policy agenda and forms of international cooperation for compliance with the SDG. 14.

Conclusions:

as partial conclusions, new forms of Cooperation are established that involve the Law of the Anthropocean, as a new strategy for the protection of the marine environment.

Palabras clave : coral reefs; CITES convention on biological diversity and the law of the sea; international cooperation; mangroves.
