In Colombia, the Political Constitution of 1991 established religious freedom, religion and conscience as fundamental rights of citizens. The State, through the years, has developed the scope of the aforementioned rights until reaching the formulation of the public policy of religious freedom and cults in 2018. Although, from a legal point of view, the State has the functions of recognition, guarantee and protection of rights so that citizens can fully exercise them in all their manifestations, it is identified that when implementing the legal system, the rules present problems in their application. The present work seeks to problematize Decree 93 of February 12, 2018 issued by the Mayor of Bogotá in the context of religious freedom as a right and the place of religion in public space, based on the question How does it guide the public policy the fundamental rights of religious freedom, worship and conscience in the city of Bogotá?
