This paper approaches, from a juridical and politological perspective, how the power and the empowerment of the parties in the family mediation configures a strategy of citizen formation. In all mediations there are games of power that cause balances and imbalances between the parties. When there are imbalances, the mediator must look for the balance in the negotiating table, empowering the parties equally by the adequate use of techniques and mediation's tools given by the mediation. Such empowerment implies a pedagogical work of citizen education with multiplier effects considering the widespread use of family mediation. These claims are the result of an investigation that combined strategies as: case study, non-participant observation of mediation's meetings about family conflict, tabulation of variables and contrasting and interpretation of results from the theoretical approach of Niklas Luhmann and the model of transformative mediation.
