While the legal systems regúlate the so-called 'sex change', the legal efffects within the sphere of personal rights are not well known. Thus, there are not always clear answers about the status of those rights whose ownership depends on the gender allocated to each person; for example, the rights arising from family relationships. In this context, based on the study of a recent Italian court decision, a critical analysis is conducted on the effects of 'sex change' in an existing marriage, with particular regard to current regulations and some mention of the Colombian model in order to determine whether the paradigm of heterosexual marriage persists.
